MOUNT VERNON, N.Y. (AP) — New York City police say a bystander has died after he was accidentally shot by a plainclothes officer who also shot an armed suspect three times after an undercover gun buy went bad. A bystander inadvertently shot by an undercover New York Police Department officer during an investigation into illegal guns on Friday has died, authorities said. Authorities say Kumi was shot Friday afternoon after a man pulled a gun on an undercover NYPD officer during a probe into the sale of illegal firearms. Kumi was inadvertently struck in the chest and arm when the undercover COP opened fire on an allegedly armed man standing in front of him near Beekman and Tecumseh avenues around 4 p.m.

They said suspect Jeffrey Aristy contacted an undercover officer with the NYPD on Friday and allegedly said he had weapons for sale, CBS2’s Ilana Gold reported. Friday on an otherwise serene residential block in Mount Vernon when the cop, sitting in a car with his mark, was about to fork over $2,200 for a pair of guns, officials said. He was told to drive to Mount Vernon, where another man got into his car and put a pellet gun to the cop’s head and demanded his money, sources said. Just then, the would-be seller, Jeffery Aristy, was joined by an accomplice, Alvin Smothers, 37, who jumped into the back seat with a pistol in hand in the Westchester County city— roughly two miles north of the city line — according to an NYPD source.

Smothers pointed the pistol — later discovered to be a fake — at the head of the officer, a member of the NYPD Firearms Investigation Unit, setting the cop into action, but also putting the bystander, 61-year-old Felix Kumi, into harm’s way.
