Albemarle Court Taking Up Sealed Motions in Hannah Graham Case.

Jesse Matthew appeared in Albemarle County Circuit Court Monday for a hearing regarding the withdrawal of a motion by the defense in the Hannah Graham case. Judge Cheryl Higgins ruled that the defense could withdraw its motion and refile it by Jan. 6, and scheduled the next hearing related to the motion for Jan. 11. Sealed motions are requests made by the prosecution or the defense that are not available to the public and are typically reviewed behind closed doors. November’s hearing had to be continued to a later date because a police officer connected to the Graham case could not be in court due to an illness.

Editor’s Note: This is a developing story, we are working to get more information and will bring you updates here on NBC29.com and tonight on NBC29 HD News at 5 and 6. Matthew, 33, is charged with abduction with intent to defile and the capital murder of late University student Hannah Graham as well as abduction and the first degree murder of late Virginia Tech student Morgan Harrington.
